Friday, September 12th, a Metrolink passenger train carrying 225 passengers crashed head on into a Union Pacific freight train. So far, 23 are known to have been killed, with 135 seriously injured, 40 in critical condition. The train crash occurred in Chatsworth, California on a sharp curve. Who Can Bring a California Wrongful Death Claim?
To be qualified to bring a wrongful death claim in California, you must have a family relationship with the deceased through blood or marriage. Under California law, and the law of many other states, cohabitating couples do not have the right to file such a claim.
