The main one is that a child can't make their own decisions and needs a guardian to protect their interests in a case. So what we do for clients is have a guardian appointed for the lawsuit. That's normally a parent, or the natural guardian. But that person will be responsible for making decisions for the child's care, as well as decisions regarding the legal case.
The same thing is true in the case of brain injured people who can't make decisions on their own, or other incompetent people who can't make decisions on their own. A legal guardian must be appointed for the claim.
